This course provides an introduction to the law, theory and practice of international commercial arbitration, and examines arbitration law and practice from a comparative, multi-jurisdictional perspective. It will also address in depth the Indian law relating to international commercial arbitration. The students will gain a theoretical and practical understanding of modern litigation and arbitration, with special emphasis on the means of anticipating problems in contractual stipulations such as arbitrability, jurisdictional clauses, choice-of-law clauses, interim measures, and arbitration clauses and enforcement of domestic and foreign arbitral awards. By the end of the course, students will have a thorough understanding of the complex international legal landscape and the implications of doing business around the world.
